Restraining orders are usually served in conjunction with pending civil or criminal court actions. Their purpose is to prevent harm to one or more parties pending the court' s decision in a legal action. To obtain a restraining order an a attorney files a request on behalf of a complainant with the appropriate court. The complainant must show good cause or a judge will refuse it "prima facia", or at first look. If the judge sees that there may be a real issue, "just cause", the restraining order request is processed through a judge (usually with a hearing, formal or informal). If approved, the restraining order is signed by the judge and filed with the Clerk of Courts. The filing attorney then has the restraining order "served" by a officer of the court, for example: the County Sheriff's office.Once served a restraining order is law! Failure to abide by it can lead to fines, contempt of court charges and jail!
Wat te doen!
If the restraining order is issued on fallacious information. Hire a good attorney. Give him (or her) all the facts, any documentation, evidence, photos, lists of witnesses, or any other pertinent information. Tell him everything. You have the right to file a request to revoke a restraining order! If the court finds that the information is wrong on the original restraining order it can be rescinded! If necessary an attorney can tell you what actions you can take to have the restraining order rescinded or nullified. This may involve filing a lawsuit, setting a hearing with the issuing judge, or counter filing.
Uitgewist gerechtelijke documenten:
Be aware that almost all legal documents can be expunged (removed) from the court records, at the order of the court (the presiding judge). This is usually reserved for criminal charges against individuals declared innocent by the court. The attorney must file a request for expunging records with the court. If the residing judge agrees then all the agencies involved clear their records. Unfortunately, with all the computerized data bases out there, including newspaper stories, inter-agency correspondence, etc... there is no way to ensure this.So your best defense is to keep copies of all court orders, filings and findings of the court. As a defendant your attorney gets copies of all documents on your behalf. Get copies from him and keep them. If there is a problem in the future you have the documents to back you up.
